4 Unusual Punishments That May Be Better Alternatives To Expensive Prisons

The deterrence theory of criminal law is about making an example of wrongdoers. As one British statesman put it:

Men are not hanged for stealing horses, but that horses may not be stolen.

In late 18th century Britain, there were 220 possible capital offenses. In actual fact, only about a fifth of death sentences actually resulted in execution. For the less severe crimes, there were ways of reducing the penalty. Benefit of clergy evolved into a one-time mercy allowance. Enlistment was another avenue. Surely this was a great recruitment tool for the British Navy. It’s certainly better to hoist ropes than to be suspended by one.

The following are some old-time punishments that have been effective deterrents. Some are rather harsh, so this is merely something to think about, not necessarily specific recommendations. We’ve covered flogging and the cucking stool before; here are some others.

Reciprocal penalty for false accusations

The first items in Hammurabi’s Law Code concerned false accusations.

If any one bring an accusation of any crime before the elders, and does not prove what he has charged, he shall, if it be a capital offense charged, be put to death.

If he satisfy the elders to impose a fine of grain or money, he shall receive the fine that the action produces.

Determining the truth of the matter involved a flotation test in the sacred river. Ancient Anglo-Saxon law had similar trials by ordeal. One method involved grabbing a stone from a cauldron of boiling water—one hand deep for ordinary cases, elbow-deep for serious ones. Making accusations required skin in the game.

Feasibility

Trial by ordeal is a bit outdated, though modern lie detectors don’t do much better. Still, making a perjurer face the same penalty as the falsely accused did is the major takeaway.

Who deserves it

Perjury and obstruction of justice are increasing problems. There have been countless cases where someone is accused of something dreadful, facing “trial by media” and general character assassination while it’s under investigation. Then when the truth comes out, the media that promoted the story (because it fit their narrative) is curiously silent. Meanwhile, false accusers are seldom punished. Instead, they get lots of attention and accolades. This needs to end.

Penal transportation

One way out of the death penalty for petty criminals in Britain was agreeing to be sent abroad. To pay for the trip, they would become indentured servants. This meant temporary slavery, though of course there were clever ways of increasing the nominal seven year term. About 50,000 came to colonial America this way. After the American Revolution, Australia became the destination for debtors and pickpockets.

Much was wrong with all this. However, removing troublemakers is needed more than ever before. If the tradition is revived, we’ll forego indentured servitude and just load undesirables onto troop transports.

Feasibility

Deportation of some of the following is already permissible.  It’s time to enforce laws already on the books, and perhaps add some new ones.

Who deserves it

First, illegal aliens should go home, no questions asked. That’s what normal countries do, including the places they came from. Also, those recently granted citizenship who become career criminals here can leave too. “Aztlan” supporters, including participants in groups advocating Mexico’s conquest of the American Southwest, are clearly subversives who should GTFO.

Foreigners advocating Sharia law should be deported, because this contradicts Constitutional law. That’s sedition. Naturalized immigrants supporting Sharia law should go too, because they lied during their citizenship oath when they agreed to accept our legal system.

Spies should be deported, even from “friendly” countries, even merely for industrial espionage. Dual citizens in government positions who agitate for wars that benefit their other country of citizenship should leave too. Those conflicts of interest are treasonable, which is why dual citizens don’t belong in government positions. Politicians, lobbyists, or media figures covering for spies or warmongers-by-proxy should leave too.

Judicial amputation

The Middle East isn’t exactly considered a high-trust society, but theft is very rare. That’s because the thief gets a hand chopped off. It’s pretty nasty, but it works. It’s excessive to punish petty theft so severely. Unlike Sharia standards, this should be reserved for the worst cases.

Feasibility

Again, this is gruesome, though the Fifth Amendment does specifically mention “crimes punishable with loss of life or member”.

Who deserves it

Robbing a liquor store might get five years in prison. However, stealing with a pen is different. White collar crooks generally get much lighter sentences (if anything), probably served in Club Fed. This is despite stealing orders of magnitude more than the contents of a cash register and a bottle of bug juice.

Suppose that if a million dollars in economic damage is involved (theft, embezzlement, stock market manipulation, etc.), chopping off the hand becomes a possibility. That would give crooks something to think about!

This can go further; over a billion could constitute capital theft. This has precedent from British law; stealing goods of twelve pence (about the price of a silver spoon then) was a hanging offense. Keep in mind that after the banksters and Wall Street whiz kids crashed the economy ten years ago, not a single arrest followed. If they’d feared becoming lamppost ornaments, maybe they’d have reconsidered their high-stakes gambling.

Jail therapy for addicts

Whenever a Viet Cong guerrilla got hooked on opium, they’d put him in a hole in the ground for three weeks. The addicts went through withdrawal, their brain chemistry normalized, and meanwhile they contemplated their mistakes. As we’ll see, Communists are more sensible sometimes than liberals.

Feasibility

Unfortunately, jailing someone for addiction was deemed cruel and unusual punishment, according to Earl Warren’s hug-a-thug Supreme Court. The Robinson v. California case of 1962 was the first misapplication of the Eighth Amendment.

Lawrence Robinson, who had needle tracks on his arm, either confessed (according to the cop) or didn’t (according to him) to using heroin. Instead of learning from his 90 day sentence, he lawyered it up to the Supreme Court. The majority opinion ruled that addiction is only a disease. Didn’t they know that junkies usually steal to support their habit? Didn’t they realize people get hooked because they abuse illegal and dangerous narcotics repeatedly? Nope; they argued that maybe he was born that wayyes, really.

Were these bleeding-hearted judges utter dimwits? Or did they understand perfectly but push a soft-on-crime agenda for nefarious reasons? Robinson himself died of an overdose before his SCOTUS appeal was even filed. However, the Supreme Court kept it going to make their point, even though the outcome obviously wasn’t going to affect the dead junkie.

Who deserves it

Fortunately, people still do get busted for dope possession, allowing them a chance (hopefully) to unscrew their heads before they kill themselves. So should addicts.

Conclusion

The US Constitution’s Eighth Amendment forbids cruel and unusual punishment. Prolonged executions like drawing and quartering, breaking on the wheel, hanging in chains, and crucifixion are indeed excessive. However, because the Constitution supposedly is a “living document”, the Supreme Court habitually legislates from the bench, especially since the liberal Warren Court. That’s why all this won’t fly.

Finally, disproportionately severe penalties are unjust. However, it’s equally true that the law is an ass.

After the fall of modern society happens (very soon), applying truly effective prevention measures to crime will be easy in WROL situation, and I expect that that is how future “legal” trials will go to because wasting peoples time and energy guarding and feeding the malcontents in “prison” will mean that summary punishments and fitting penalties will become common place and sensible. As far as drug addicts are concerned, their addictions will be punishment enough as most will likely succumb to overdoses or bad trips or will detox and move on, addicts who live through criminal activities to pay for their addictions will likely just be summarily executed when caught by their intended “victims” or as a coincidence of their actions…Karma is funny in that that undiscriminating bitch will get what she wants and the guilty what they deserve…..Finally and ironically. We are halfway there already as few have sympathy for dead perps anymore, and that lack of sympathy is increasing daily.

    I don’t see why most states abolished this form of execution. It is one of the most humane ones out there. And these ought to be done publicly as they have been done throughout the course of Western History, even after WWII (according to a brief internet search the last public hanging in the US was in the 1950’s in Delaware).
    If the government is going to be vested with the power to legally kill people it ought to do it in a public and transparent fashion. A big portion of the death penalty is the deterrent factor. Hard to have that when the death chamber is behind barbed wire, walls, and generally free of media coverage.
    THE STOCKS
    Petty crime should be punished by a day and night in the stocks. Steal from the local corner store. Well your crime gets posted above your head and you get to spend an uncomfortable night in the stocks located at the public park. How many repeat offenders are you going to get with this punishment?
    WORK CAMPS
    The US has so many over due and necessary public projects that need attention, why don’t we get the non-violent offenders out of the jails and put them to work. I say we even pay them a fair wage. Those with technical skills can be put to useful work. Those without can collect trash from city streets, be trained to fix things like pot holes, etc. Hours of work translate to both money and credits. When a convict gets enough credits they are released. This will encourage good work and perhaps even some overtime.
    BANISHMENT
    If a convict has no legal right to remain int he United States they ought to be deported automatically upon conviction. If the appeals court wants to stay it fine – but they would have to take an affirmative action to do so. Otherwise it is on the next plane back to their country of origin. If they sneak back in and get caught it is off to the work camps.

    1. This strategy is called “anarcho-tyranny”. One typical application is where the government does the following:
      1) Tolerate street crime and accept migrants from places that are incompatible with the local culture
      2) After a very predictable crisis happens because of that, keep going with item 1 but crack down on regular people to make it look like they’re “doing something”
      3) Get more funding for the extra security infrastructure that’s largely ineffective against the problems caused by item 1, but great at furthering item 2

  6. The failure to punish criminals is a way of demeaning and discouraging citizens. Often criminals might be “rehabilitated”, given education and set up with jobs while their victims continue to suffer from the losses caused by crimes.
    The recent freeing a drunk rich kid who killed four innocent persons because he had “affluenza” can be seen as an effort to show the rest of us that rich elite kids have the right to drink and drive, a right more important than mere ordinary people’s lives.
    Refusal to punish is a scam to debase and defeat the rest of us, preparing society for arbitrary absolute power.

A solution to the problem of illegals that reenter the country after being gently released would be to crush their knee in a vice, warn them about getting their other knee crushed if caught next time, and RFID chip them before releasing them. That way they would be easier to identify, it would restricts their mobility, making it harder for to repeat their crimes.

Decent men have been emasculated completely, and the result is that only human garbage that do not have the long time impulse control to avoid prison in the first place are the only ones capable of acting at all. Remove the restrictions on medical insurance companies to give insurence to who they wish, adopt the Thailand system of medical care. Any public education can only exist if the parents have the individual right to withdraw and use the same tax dollars on religious education. Send back all immigrants, cancel external work visas,and start breaking up those monopolies that are trying to get cheap labor at the expense of the common man.

  12. Bring back caning as an option for certain crimes (mainly offenses that would carry a jail sentence of up to 5-8 years or so). Why send a 19-year-old who commits a crime of moderate seriousness (something like sticking up a convenience store) to prison for half a decade, where he can develop into a hardened criminal and likely a lifetime of recidivism while sucking up tens of thousands of taxpayer dollars a year, when you can give him a certain number of lashes (say, one lash per 3 months of his jail sentence) and send him on his way?
    I wouldn’t ever mandate caning–it would be up to the judge to give it as an option on a case by case basis, based on whether he believes it would be more likely than prison to keep society safe and potentially help the convicted turn into a productive citizen. And the convicted, if offered the choice of caning, would always have the option to accept it or serve time instead. But I think this would have the dual effect of saving a ton of taxpayer money while also allowing criminals who are not complete lost causes, particularly younger first time offenders, to endure some short-term physical pain without having their lives permanently ruined by a prison sentence.
